Demerit Points

NOVICE DRIVERS

If you hold a G1, G2, M1 or M2 licenses, and are convicted of distracted driving, you’ll face the same fines
as drivers with A to G licences. But you won’t receive any demerit points. Instead of demerit points you’ll
face longer suspension.

First Conviction

  • Thirty (30) day license suspension

Second Conviction

  • Ninety (90) day license suspension

Third Conviction

  • Cancellation of your license and removal from the Graduated Licensing System (GLS)
  • To get your licence you’d have to redo the GLS program

FIVE CONDITIONS FOR G1 DRIVERS

  1. Must always have an accompanying driver in the front passenger seat. They must;
    • Be fully licensed and have atleast 4 years of driving experience
    • Have a blood alcohol concentration (BAC) of less than 0.05 %. If the accompanying driver is 21 years
      of age and under, they must have ZERO % to assume driving duties.
  2. Be the only other person in the front seat.
  3. Have a ZERO % blood alcohol concentration (BAC)
  4. Cannot drive between 12:00 midnight and 5:00 AM.
  5. Ensure that everyone in the vehicle have a seatbelt. One person per belt.
  6. Cannot drive on any Ontario 400 series with a posted speed limit greater that 80 km/h, (QEW, DVP,
    Gardiner Expressway, E.C Row Expressway or Conestoga Parkway) Unless accompanied by Certified Driving
    Instructor.

THREE CONDITIONS FOR G2 DRIVERS

  1. Have a ZERO % blood alcohol concentration (BAC).
  2. Ensure that everyone in the vehicle have a seatbelt. One person per belt.
  3. Teenage G2 drivers must limit the number of passengers under the age of 20 late at night.
    • For the FIRST SIX MONTHS – G2 drivers aged 19 and under cannot carry more than ONE Passenger aged 19 and under between midnight and 5:00 AM*
    • For the SECOND SIX MONTHS – G2 drivers aged 19 and under cannot carry more than THREE Passengers aged 19 and under between midnight and 5:00 AM*

*Does not apply if your only front seat passenger is a fully licensed driver with four or more years of driving experience, or if the young passenger are your immediate family.

DISTRACTED DRIVING PENELTIES FOR FULLY LICENSED DRIVERS

G-Licensed driver is considered as fully licensed driver

Demerit points stay on your record for Two (2) years from the offence date. If you collect enough points, you can lose
your driver’s license when you violate driving laws in; other Canadian provinces and territories

If you have an A, B, C, D, E, F, G and/or M license, you’ll face bigger penalties when convicted of distracted driving.

First Distracted Driving Conviction Penelties

  • For a first distracted driving offense, you can expect the following penelties
  • A fine of up to $1,000/=
  • Three (3) demerit points
  • A three (3) day driver’s license suspension, unless you have a graduated license, like a G1 or G2, then the license suspension is for 30 days.

Second Distracted Driving Conviction Penelties:

  • For a second distracted driving offense within five years, you can expect the penelties to double
  • A fine of up to $2,000/=
  • Six (6) demerit points
  • A seven (7) day license suspension, unless you are a G1 or G2 license holder, then the license suspension is for 90 days

Third Distracted Driving Conviction Penelties:

  • For a third distracted driving offense within five years, the penelties increase progressively, and include;
  • A fine of up to $3,000/=
  • Six (6) demerit points
  • A thirty (30) day driver’s license suspension, unless you are a G1 or G2 license holder, then your license could be cancelled – and it can be difficult to get the license back.
